(“Krayo,” “Company,” “we” or “us”) and applies to information collected when you use or access Krayo’s website at www.krayo.io , and any other website that we operate (each, together with its sub-domains, content and services, a “Website”) or when you use the services we offer (our “Product”) (together with the Website, the “Service”). The Service may be available for use via a web browser or applications. We respect the privacy rights of users and recognize the importance of protecting the information collected about you.

References to “you,” “your,” or “user” means the end-user utilizing or accessing the Service.

Please read the following carefully to understand how we will collect, use, and maintain your Personal Information, as defined below. It also describes your choices regarding the use, access, and correction of your Personal Information. By accessing and using our Service, you signify acceptance to the terms of this Privacy Policy.

We do not ourselves host any of the Website and/or Service - all hosting is done by third-party service providers that we engage. This means that data you provide us or that we collect from you (including any Personal Information) – as further described in this Privacy Policy – is hosted with such third-party service providers on servers that they own or control. Regardless of where such third-party service providers are located, their servers may be located anywhere in the world (including the US). Your data may even be replicated across multiple servers located in multiple countries. So please be aware that you are consenting to your data being transferred to various third-party service providers around the world.
“Personal Information” means any information that may be used, either alone or in combination with other information, to personally identify an individual, including, but not limited to, a first and last name, a personal profile, an email address, a home or other physical address, or other contact information.

2. Changing our Policy

If we make any changes, we will revise the "Last Updated" date at the end of this Privacy Policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). Such change will be effective ten (10) days following the posting of the revised Privacy Policy on the Website, and your continued use of the Service thereafter shall constitute your consent to such changes. We encourage you to review our Privacy Policy whenever you access the Service to stay informed about our information practices and the ways you can help protect your privacy.

When you contact us or interact with our Service, we may receive and/or collect information (including Personal Information) as follows:
Information You Provide to Us:

Account Information: We may collect your name, postal address, email address, and phone number when you register for our Service, or otherwise communicate with us.

“Get In Touch” Information: If you send us a “Get In Touch” request, whether by submitting an online form that we make available or by sending an email to an email address that we display, you may be required to provide us with certain information such as your name and email address.

Social Media: We also have pages on social media sites like LinkedIn and/or Twitter (“Social Media Pages”). When you interact with our Social Media Pages, we may collect Personal Information that you elect to provide to us through your settings on such social media site, such as your contact details. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages.

Service Purchases: The Website and/or Product may include the option to purchase certain products or services from us. If you choose to make a purchase, we will require sufficient information from you to complete the transaction. Such information could include your billing information (including debit card and/or credit card number, expiration date, billing address, and other payment-related information), and other data required to process the order. We may also update such data should you permit us to bill you or your credit card for recurring charges, such as monthly or other types of periodic payments. We use third-party service providers to process transactions, in which case you acknowledge and agree to review and be bound by the terms of service and privacy policy of said third-party service provider.

Product Integrations: You (or your organization) may voluntarily choose to provide additional Personal Information as part of the account registration process and/or in connection with your ongoing use of our Service, directly or through third-party service integrations, e.g.

a. your organization's financial information (including access credentials, and financial accounts that you elect to connect to the Service);
b. your employee information, compensation information, and other identifiers specific to you such as your gender and ethnicity.

Google API Integration: Krayo's use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

We may also collect the information posted by you to the Service (such as comments, suggestions, feedback, opinions, or media) and any other Personal Information you submit through the Service or to us in the form of an email.

Information We Collect Automatically:

Usage, Log, and Device Information: We may collect information from your use of the Service such as system activity, hardware settings, browser type, browser language, the date and time of your visit, and the referral URL. We monitor user activity in connection with the Service and may collect information about the features you use, the content you upload, download, share, or access while using the Service, and any actions taken in connection with the access and use of your content in the Service.

5. How We Share and Disclose Information

We will not share Personal Information about you or any content with any third parties except as described in this Privacy Policy, or as defined in an agreement with us, in connection with the Service. For example, we may share personal information about you:

To Vendors, Consultants, and Other Service Providers: We may share your information with third-party vendors, consultants, and other service providers who are working on our behalf and require access to your information to carry out that work, including companies that provide services such as cloud hosting and customer database software. These service providers are authorized to use your personal information only as necessary in the course of performing their duties to Krayo.

In Compliance with Laws: We may disclose your information to a third party: (a) if we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request; (b) to enforce our agreements and policies; (c) to protect the security or integrity of the Service; (d) to protect Krayo, our customers, or the public from harm or illegal activities; (e) to respond to an emergency which we believe in the good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person; or (f) as otherwise directed by you.

For Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets. You may be notified thereafter via email of any such change in ownership or control of your personal information.

6. Aggregate Anonymized Information

Notwithstanding the restrictions above and elsewhere in this Privacy policy, you expressly agree that the Company retains the right to use, sell, disclose, transfer, or rent any user information as long as such information is in an aggregated anonymized form that does not include any individually identifiable user information, and/or identify you. Further, the Company retains all rights on the use of statistical information, as well as on data and related analysis in aggregate anonymized form, deriving from the use of the Service by its users. For the sake of clarity, such aggregate anonymized information does not include Personal Information, and the user expressly authorizes the Company to use the same to improve the functionality of the Services or to publish the statistical information in aggregate form or for any other requirement that the Company deems fit.

We keep Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so, or as required by law (e.g. for tax, legal, accounting, or other purposes), whichever is the longer.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt-out of receiving these communications and in accordance with our policies.

To determine the appropriate retention period for your Personal Information, we will consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we use your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

8. Update Your Information

If you need to change or correct your Personal Information or wish to have it deleted from our systems, you may contact us at privacy@krayo.io. We will address your request as required by applicable law.

9. Email Policy

We may use your email address to communicate with you about orders you have placed, inquiries you have made about our products and services, or information you have shared with us through the Site or email. We may send you emails from time-to-time, about information that we believe may be of interest to you. We may also send you news and offers about our products and services, or those of our chosen partners.

If at any time, you would like to stop receiving these promotional e-mails, you may follow the opt-out instructions contained in any such e-mail or by writing to us at privacy@krayo.io. Please note that it may take a few business days for us to process opt-out requests. If you opt out of receiving emails or promotions, we still may send you e-mails to you in accordance with this Privacy Policy, as requested by you, or in reference to other customer service purposes.

10. Third-Party Links

Our Service includes links to other, third-party websites whose privacy practices may differ from those of Krayo. Any access to and use of such linked websites is not governed by this Privacy Policy, but, instead, is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites. We encourage you to carefully read the privacy policy of any website you visit.

11. CCPA

The “California Consumer Privacy Act of 2018” or “CCPA” became effective January 1, 2020. The CCPA grants California consumers new rights related to their personal information. The CCPA affords California consumers new rights to transparency about data collection including rights to control access and use of their personal information. We do not sell your Personal Information. We do share some of your information with our trusted service providers, to market our services and operate the Service. We do not allow these third parties to use your information for their own purposes.

Some browsers offer a “do not track” (“DNT”) option. Because no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, our Website currently does not respond to DNT signals and operates as described in this Privacy Policy. We will make efforts to continue to monitor developments around DNT browser technology and the implementation of a standard. If we do respond to DNT signals in the future, we will describe how we do so in this Privacy Policy.

12. International Users & GDPR

We have implemented safeguards to ensure an adequate level of data protection where your Personal Information is transferred outside of the EEA, such as by means of our customer data processing addendum by means of which we implement the standard contractual clauses for the transfer of Personal Information as approved by the European Commission (Article 46 GDPR).

13. Children

The Service is not directed to individuals under 18. We do not knowingly collect personal information from children under 18. If you become aware that a child has provided us with personal information, please contact us at privacy@krayo.io. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete such information. If you are under the age of 18, you may not use our website, products, or services.

14. Security

You use the Service at your own risk. We follow generally accepted industry standards to protect Personal Information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error-free. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.

15. Your Choices

Whether or not you provide Personal Information to us is completely up to you, but if you choose not to provide information that is needed to use some features of our Service, you may be unable to use those features. You can also contact us to request access to your data or to ask us to update, correct, or delete your Personal Information.
